About these terms
These terms apply to the services Sport Surface King ("we", "us") offers, including contractor matching, scope reviews, consulting and training. By sending us a project, using our services or joining our contractor network, you agree to them. If you don't agree, please don't use our services.
Using the website itself is covered by our Terms of Use, and how we handle personal information is covered by our Privacy Policy. Together with any written agreement we sign with you, these documents make up the whole agreement between us about our services.
What we do
We help property owners plan sport surface projects and introduce them to independent contractors and equipment suppliers who work in their region. We also offer consulting, training and resources to contractors.
We are not a contractor on your project. We don't build, resurface or repair courts ourselves, and we don't supervise, direct or control the crews we introduce.
Fees and how we're paid
Matching is free for homeowners, municipalities and businesses. You never pay us for an introduction.
Contractors in our network don’t pay a membership fee. They pay us a referral fee only on completed contracts and equipment sales that come from our introductions. We tell you this so you know how we’re paid. We choose which contractors to introduce based on how well they fit your project.
Consulting and training may also carry a fee. We will always agree any fee with you in writing before the work starts.
Your responsibilities
When you send us a project, you agree to:
Give us accurate details about yourself and your site
Be the owner of the property, or have permission to plan work on it for the owner
Only send photos and files you have the right to share
Let us know if your project is cancelled or put on hold
How we and contractors contact you
When you send us a project, you agree that we, and the contractors we introduce you to, may contact you about it by phone, email or text message. Standard message and data rates may apply.
We'll only send you news or offers if you separately agree to receive them. You can ask us to stop contacting you at any time, and we'll let the contractors we introduced you to know as well.
The contractors we introduce
Contractors in our network are independent businesses. They are not our employees, agents or partners, and they can't make promises or sign agreements on our behalf.
Before a crew joins our list, we ask for proof of liability insurance and workers' compensation coverage, call their references and look at finished work. These checks are a snapshot taken when the crew joins and when we review them. The information can go out of date, and an introduction is not an endorsement, guarantee or warranty of their work, pricing, schedule or conduct.
Before you sign, confirm the contractor's business licence, insurance certificate, workers' compensation clearance, references and warranty terms for yourself.
Quotes, contracts and payment
Any quote, contract, equipment order or warranty is between you and the contractor. We are not a party to it, and we don't take or hold payments for contracted work or equipment. Permits, inspections and site safety are the responsibility of you and your contractor.
Scopes and advice we give you are based on the information and photos you provide. They are general guidance, not an engineering assessment, a site survey or a guarantee of cost.
If something goes wrong with a contractor
Disagreements about the work, equipment, price or schedule are between you and the contractor. We're happy to help you talk it through, but we can't act as a referee, arbitrator or guarantor. Please tell us about any problem so we can decide whether that contractor stays in our network.
Photos and details you send us
You keep ownership of the photos and files you upload. You give us permission to use them to review your project and to share them with contractors we introduce you to. We won't use them in our marketing without asking you first.
Contractor members
Contractors who join our network agree to a separate referral fee agreement. Members must keep their insurance and workers' compensation coverage current and tell us straight away if it lapses. We may pause or end introductions to any contractor who no longer meets our requirements or who leaves owners unhappy.
Training and workshops
If you attend our training, workshops or on-site demonstrations, you agree to follow our safety instructions and site rules, wear any protective equipment we ask for, and tell us about anything that could affect your safety. You take part at your own risk, and you’re responsible for your own tools, equipment and conduct.
To the extent the law allows, we’re not liable for any injury, loss or damage that happens during or as a result of training. We may also ask you to sign a separate waiver before an in-person session.
Ending or pausing our services
You can stop using our services at any time. We may decline a project, or stop working with anyone who breaks these terms, gives us false information, or treats our team or contractors abusively.
Limits on our liability
To the extent the law allows, we are not liable for a contractor's work, the equipment they supply, delays, pricing or conduct, or for any injury, property damage or loss that results from it. We are also not liable for indirect losses such as lost profits, lost revenue or lost use of a facility.
If we are found liable to you, our total liability is limited to the fees you paid us in the 12 months before the claim, or $100 if you haven't paid us anything.
Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived, or our liability for our own fraud or gross negligence.
If you break these terms
If you break these terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, including legal fees, to the extent the law allows.
Events outside our control
We aren't responsible for delays or failures caused by things we can't reasonably control, such as severe weather, a short building season, supplier shortages, internet or power outages, or public health orders.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the date at the top of this page. Using our services after an update means you accept the new terms. Changes won't affect a project we've already agreed to in writing.
Governing law and disputes with us
These terms are governed by the laws of Canada and of the province or territory where you live, unless the law requires otherwise. If you have a concern about our service, please contact us first so we can try to fix it. If we can't resolve it together, either of us may take it to the courts of that province or territory.
General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to do so later. You can't transfer your rights under these terms without our written permission. We may transfer ours if our business is sold or reorganized. Nothing in these terms makes you and us partners, employer and employee, or agents of each other.
